2.      Definitions

  • Feel Medellín A.S: It is the intermediary between the User and the Service Provider.
  • User: The person who purchases the product or service as the end

Users are prohibited from misusing Feel Medellín’s marketing channels, impersonating others, using buyers, and engaging in fraudulent activities on the channels.

  • Minors Policy: If a minor wants to access any of Feel Medellín’s services, he/she must be accompanied by his/her legal representative or an adult authorized by his/her legal

The supervising adult is responsible for the activities of the minor during the services and must follow the recommendations provided both during the reservation process and by the Provider.

The fee for minors is the same as for adults, unless otherwise specified in the details of each tour, where a different rate may apply based on the child’s age.

Feel Medellín S.A.S complies with Law 679 of 2001, which establishes the statute to prevent and combat the exploitation, pornography, and sexual tourism of minors, in accordance with Article 4 of the Political Constitution.

  • Services Offered: Feel Medellín S.A.S is committed to offering the User a seamless experience by providing services related to the planning, logistics, and execution of a tourist trip, experience, or activity, as well as delivering a product based on the User’s selected preferences.

Feel Medellín S.A.S constantly updates and reviews the services displayed in its marketing channels Feel Medellín S.A.S reserves the right to modify and remove products and/or services displayed in these channels at any time.

The product or service reserved by the User includes only what is explicitly detailed in the specific channel or program. Any items or services not mentioned are excluded.

The quote will be sent within the next 48 hours from the receipt of the request. Each quote will have an expiration date set at the discretion of Feel Medellín S.A.S.

  • Validity Period of the Offers: Each offer will have a validity period chosen at the discretion of Feel Medellín S.A.S.
  • Confirmation of Reservation or Purchase: Once the User’s reservation or purchase of the contracted services or products is confirmed, Feel Medellín S.A.S will send a confirmation email with all relevant instructions for the successful provision of the service or delivery of the
  • Prices: Our prices are in U.S. dollars and are subject to change without prior notice. The product or service description will state the approximate value in Colombian Pesos; however, the applicable market exchange rate at the time of payment may differ from the description.

The prices provided on Feel Medellín’s marketing channels are not guaranteed until online payment is made.

These prices include all direct and indirect costs of the contracted service, as well as Feel Medellín’s fees. In addition, the User will be informed of the cost of taxes and the payment methods used for their purchase.

  • Discounts: To receive a discount using a promotional code, the User must enter the code at the time of purchase, and the corresponding discount will be applied.

Only one discount can be used per transaction; multiple discounts cannot be combined.

  • Method of Payment: The User is required to pay Feel Medellín S.A.S 100% of the fee prior to the provision of the service or delivery of the The User must retain the payment receipt, as failure to provide proof of payment may result in the cancellation of the request.

If the User fails to make the payment on time, the contract will be automatically terminated, and Feel Medellín S.A.S will not be obligated to refund any amounts paid that are non-refundable by its suppliers.

Feel Medellín S.A.S will provide the User with available payment methods to fulfill this obligation, including but not limited to:

  2. Payment via PayU or Wompi, accepting the following credit cards: American Express, MasterCard, Visa, and Diners Club Payments can be made through the following

banks: Bancolombia, Banco de Bogotá, Davivienda, and Grupo AVAL. Cash payments are accepted via Efecty, Su Red, Vía, and Baloto, as well as bank transfers through PSE.

  1. If the User makes a payment through this method and later exercises their right to request a payment reversal, they must provide valid justification in accordance with applicable regulations. If it is determined that the Contractor acted in bad faith, they will be subject to the penalties outlined in Law 1480 of 2011, which may include fines of up to fifty (50) current legal monthly minimum wages (SMLMV).

Feel Medellín S.A.S is not obligated to issue refunds to the User in cases where the contracts with service providers do not legally or customarily allow for withdrawal or reimbursement in the event of service cancellation.

  • Right of Withdrawal: The User may exercise the right of withdrawal within 5 business days from the date of signing this contract by sending a written communication to admin@feeltourismexperiences.com. This right applies only to distance sales and to goods that, by their nature, cannot be consumed or to services that must be performed in a period exceeding 5

The right of withdrawal will not apply when (i) the provision has begun with the User’s consent; (ii) the contract concerns the delivery of goods that, by their nature, cannot be returned or which can deteriorate or expire quickly; (iii) the production of personalized or customized goods according to the User’s specifications.

If the User decides to exercise this right within the specified period, Feel Medellín S.A.S has a period of 30 calendar days to refund the money paid by the User.

In no other case is the exercise of the right of withdrawal permitted; therefore, if the User requests the cancellation of the service, Feel Medellín S.A.S is not obligated to refund the money.

  • Cancellation or modification of the reservation: Once the period of exercising the right of withdrawal has expired, the User may not request the cancellation of the services included in this contract. If the User wants to cancel the service, Feel Medellín S.A.S is not obliged to refund the money paid by the User unless the refund policies of the providers allow for it.

The User cannot modify the contracted services and conditions, except in the following cases:

  1. If the request is to increase the number of people, the User may do so up to eight (8) days before the scheduled date and time for the provision of the service. In this case, Feel Medellín will inform the User of the cost of the service for the additional number of people

In the event the contracted services need to be canceled, Feel Medellín S.A.S will receive the User’s request up to twenty (20) days before the scheduled date and time for the provision of the Feel Medellín S.A.S will only reimburse the User for the amount refunded by the provider in accordance with its cancellation and refund policies. Cancellations made with less than 24 hours notice will not be refunded.
  5. If a change in the date of any contracted service is required, Feel Medellín S.A.S will receive the User’s request up to eight (8) days before the scheduled date and time for the provision of the service. If the request is made on time, Feel Medellín S.A.S will check the availability to make the change, and any additional costs resulting from this change will be borne exclusively by the User. If the request is not made in time or if there is no availability to make the date change, Feel Medellín S.A.S will only refund the User the amount that the provider will refund in accordance with their cancellation and refund policies.
  6. Changing from one tour to a different one is not allowed; only changes to the initially reserved service are permitted.
  7. If the provider does not refund any amount to Feel Medellín A.S, Feel Medellín S.A.S is not obliged to refund the User.

Force majeure events include, but are not limited to, natural disasters (such as earthquakes, tsunamis, storms, or weather conditions that prevent air or sea transport), government actions that impede service provision, the actions of the User or Beneficiary, border closures, visa or permit denials, accidents, strikes, riots, security concerns, political factors, health-related issues, and similar circumstances.

Paragraph One: In the event that the service is interrupted due to force majeure or unforeseen circumstances, Feel Medellín S.A.S shall not be liable for any damages, losses, or harm caused to the User. Furthermore, the termination of the contract under these circumstances shall not obligate Feel Medellín S.A.S to financially compensate the User for the total value of the service, but only for the amounts recovered from providers who have issued refunds.

  • Refunds: If a refund is applicable due to cancellations or changes, it will be processed by crediting or reversing the charge to the User’s credit card. If the payment was made via bank transfer, Feel Medellín S.A.S will request the User’s information again in order to process the refund through this method.

The bank or administrative fee charged by Feel Medellín S.A.S is non-refundable and amounts to 10% of the reservation value. In the event of cancellation of confirmed reservations, this fee will not be refunded, as it corresponds to a service that has already been provided by Feel Medellín S.A.S.

  • Informing the User of any restrictions that may impact the tour or service, or any of its components, such as maximum capacity limits for attractions or tourist sites. Therefore, any claims related to inadequate services provided by a supplier must be directed to the supplier directly, with Feel Medellín S.A.S not being held liable for any damages arising from such situations.

Paragraph Two: Feel Medellín S.A.S does not guarantee that its marketing channels will be uninterrupted or free from errors. Under no circumstances shall Feel Medellín S.A.S be held responsible for any damages arising from the use or inability to use the marketing channel, including errors, omissions, interruptions, file deletions or corruption, viruses, delays in operation or transmission, or any other type of malfunction.

Paragraph Three: Liability for Failure to Make Payment or Provide Information: Feel’s liability towards the User shall be limited to the proper provision of the contracted services as outlined in this document. Under no circumstances shall Feel Medellín S.A.S be held liable for the failure to provide services due to non-payment, incomplete or incorrect information provided by the User, or any other cause attributable to the User.

  • Duty of Care and Custody of Personal Property: Feel Medellín S.A.S does not assume the custody and care of the User’s personal This means that Feel Medellín S.A.S will not be responsible in case of loss or damage of the objects. Therefore, the User must take care of the custody and care of their personal belongings, assuming responsibility in case of loss or damage to them.

This includes ensuring the establishment has adequate security measures to protect the items and will take responsibility in case of loss or damage.

If the company cannot guarantee this duty of care, it is advised NOT to leave valuables at the facility, as Feel Medellín S.A.S will not be held responsible for any loss or damage.

  • Indemnification: The User will indemnify and hold Feel Medellín S.A.S harmless from and against any claim, demand, action, or suit (including, without limitation, reasonable attorney’s fees and costs of litigation) arising out of or related to any act or omission of the User or Feel Medellín

S.A.S in the performance of the services provided under this Agreement, or any failure to comply with any applicable law for providers.

The User will reimburse Feel Medellín S.A.S for all legal fees and other costs incurred in the defense of the claim.

For the collection of the obligations established in this clause, the contract will serve as an executory title, together with the proof of payment of the damages, penalties, or expenses provided for in this clause.

Paragraph One: In any case, Feel Medellín S.A.S reserves the right to take the necessary legal actions to enforce the provisions of this clause, including seeking compensation for any costs incurred in its defense and pursuing the recovery of damages through executive proceedings, where the immediate payment of outstanding amounts may be demanded, without prejudice to any other applicable legal remedies.

monitoring the agreed activities. However, this does not imply any direct responsibility for the services provided by these suppliers or contractors.

Paragraph One: Feel Medellín S.A.S assumes no joint liability for the actions, services, or omissions of suppliers or contractors, who remain solely responsible to the User for the services they deliver and the results they produce. The User acknowledges that any claims or concerns regarding the quality, compliance, or conditions of services provided by suppliers must be directed solely to those suppliers, and Feel Medellín S.A.S shall not be held accountable for such issues.

Paragraph Two: As an intermediary, Feel Medellín S.A.S will act solely as a broker or facilitator between the User and the suppliers/contractors, without assuming any liability for their acts, omissions, breaches, or errors. Feel Medellín S.A.S shall not be held responsible for any damages arising from the execution of the suppliers’ services, whether due to defects, delays, deficiencies in service quality, or any other related cause. However, in the event of non-compliance by suppliers, Feel Medellín S.A.S commits to assisting the User in managing and processing the necessary claims with the involved suppliers, without this implying any assumption of liability on the part of Feel Medellín S.A.S.

The User declares that he/she has obtained the consent of the persons he/she represents to the processing of his/her data, and specifically to the provision of such data to Feel Medellín S.A.S and its providers.

  • Intellectual Property: All computer, graphic, advertising, photographic, multimedia, audiovisual, and design materials, as well as all content, text, and databases (collectively referred to as “the Content”) made available on this website, are the exclusive property of Feel Medellín

Additionally, should the User be included on any list as a suspect of money laundering, this will constitute valid grounds for the termination of any contract or agreement between Feel Medellín S.A.S and the User.

  • Acceptance: By continuing to use Feel Medellín’s marketing channel, the User acknowledges having read and understood these terms and conditions and agrees to comply with them and comply with all applicable laws and regulations that are part of the Colombian Those Users who decide to access Feel Medellín’s marketing channels from other countries do so at their own risk, and it is their responsibility to comply with the local laws that apply. Any claim related to the use of Feel Medellín’s marketing channels and the material contained therein shall be governed by the laws of Colombia.

Feel Medellín’s marketing channels are controlled and operated by Feel Medellín S.A.S, and access from territories where its content is illegal is prohibited. If the User does not agree with these Terms and Conditions, he/she must refrain from using Feel Medellín’s marketing channels.

  • Authorization for the use of image rights for photographs and videos: The User and their beneficiaries hereby grant authorization to the Feel Medellín S.A.S to utilize image rights for photographs, analogues to photography, or audiovisual productions (videos), along with associated copyrights and intellectual property rights. This authorization extends to FEEL MEDELLÍN A.S. for use across its social media platforms, as well as in printed and electronic materials, for the promotion of its services and digital marketing campaigns.
  • Changes to the Terms and Conditions: These terms and conditions are subject to change without prior notice. At any time, at the discretion of Feel Medellín S.A.S, and from the date of modification of these terms and conditions, all transactions between Feel Medellín S.A.S and the User will be governed by the modified document.
